WILMINGTON, N.C. (WECT) - Three of four charges against a man accused of drugging two teens’ Dairy Queen blizzards have been dropped, according to newly filed court documents.

On Aug. 3, Wilmington Police Department (WPD) charged and arrested James Yokeley Jr. for allegedly putting pills in his 16-year-old step-granddaughter’s and her 15-year-old friend’s Dairy Queen blizzards.

Detectives requested security camera footage from the Dairy Queen location, and WPD claimed the footage showed Yokeley had placed the two pills into the ice cream.

Yokeley Jr. had been charged with:

  • Two counts of felony contaminating food or drink with a controlled substance
  • Felony child abuse
  • Felony possession of Schedule I narcotics

An arrest warrant alleged that the blue pressed pills were tested in the field and were positive for MDMA and Cocaine.

However, new court documents filed on Dec. 22 state the three drug charges against Yokeley were dismissed due to “insufficient evidence to warrant prosecution for the following reasons: lab testing confirmed the substance was not a controlled substance under NC GS.”

A spokesperson for the New Hanover County District Attorney’s office confirmed only one felony child abuse charge is still pending against Yokeley at this time.
