WILMINGTON, N.C. (WECT) - A civil suit filed by the former owner of Edward Teach Brewery against an employee who is accusing him of assault has been involuntarily dismissed.

David Gary Sholar applied for a civil summons on July 24, one day after he allegedly attacked an employee at Longhorn Steak House on July 23 at around 1 p.m.

The deadline for Sholar to file the complaint was Aug. 13, 2025. But it was not filed, so a judge dismissed the suit on Wednesday, Aug. 20.

WPD reports that Sholar was dining at the restaurant with his dog and feeding it from the table when an employee informed him it was a health code violation.

Sholar is accused of throwing a porcelain plate at the employee’s head and causing a hairline fracture. He was arrested on Aug. 7 after an investigation and charged with assault inflicting serious injury. He was given a $1,000 secured bond.

According to court documents, Sholar claims the employee “assaulted and battered” him and “initiated contact with, and applied force” to his body without his consent.

WECT has reached out to Sholar’s lawyer to see if he plans to file the complaint again.
