WILMINGTON -- An illegal immigrant is formally charged with involuntary manslaughter and driving while impaired.
According to prosecutors, Martin Vazquez, 42, crashed into a car driven by Benedict Randolph and killed him.
Police said Vazquez was drunk when he slammed into Randolph's car, as Randolph was pulling out of an ExxonMobil gas station.
Vazquez will return to court on October 9. He can then either plead guilty or decide to go to trial.
Vazquez could face up to four years in jail in convicted. He would be deported afterwards.
