MAY 26, 2006 -- A defense attorney in a Wilmington murder trial is out of the hospital and says the trial should resume Tuesday.
Bill Peregoy had surgery and is expected to make a full recovery. He represents Demond Wells who is charged with second degree murder. Prosecutors say Wells shot and killed Roncin Sanders in December of 2002.
Tuesday morning, prosecutors plan to call a key witness who they say saw the shooting take place. So far, witnesses for the prosecution testified they've only heard the gunshots. They say they didn't actually see Wells shoot Sanders.
