BOILING SPRING LAKES, NC (WECT) - The City of Boiling Spring Lakes has settled a lawsuit with a couple over a flooding issue.
Christopher and Karen Thompson's yard was flooded in 2013 when the city raised the lake level in Spring Lake at the request of another resident.
The Board of Commissioners voted this week to pay the Thompsons $70,000. That will cover several thousand dollars in damages to their bulkhead and landscaping damaged by the flooding as well as their attorney's fees for the lawsuit filed in 2014.
The lawsuit filed by the Thompsons' neighbor, Ed Wilkie, has not been resolved. Wilkes asked the city to pay him $1,500 after his landscaping was damaged by raising the lake level.
The city refused to pay Wilkie and has since spent around $300,000 from its general fund fighting the lawsuit he filed. Wilkie's case went as high as the North Carolina Supreme Court, which ruled in March 2018 that Wilkie had the right to be compensated for the taking of his land. His case has been remanded to a lower court to work out the details.
The $70,000 settlement to the Thompsons releases the city from any further liability in their case.
