JANUARY 26, 2005 -- The man accused of killing Boiling Spring Lakes Officer Mitch Prince will be back in court next week, where prosecutors say they plan to announce plans to seek the death penalty. Darrell Wayne Maness is scheduled to go to court Monday in Brunswick County.

A grand jury indicted Maness on charges of first-degree murder.

He's accused of shooting Prince after the officer stopped Maness on a traffic violation on January 18th.

According to District Attorney Rex Gore, on Monday the judge will rule officially on it being a capital murder case. He says it then goes into case management, which starts the process of trial preparation.
