UPDATE: Case dismissed and then reinstated against NHC teacher

NEW HANOVER/BRUNSWICK COUNTY, NC (WECT) -

The case against a New Hanover County teacher accused of making threats does not appear to be over yet.  

According to the Brunswick County clerk's office, Ashley teacher Wanda Leggett's case was dismissed with leave on September 19. That means the case could be reopened within the next two years and the charge will still be on her criminal record.  

Assistant District Attorney Fred Gore said the case has been reinstated as of last week after one of the parties was not satisfied with the outcome of a mediation process. 

Leggett was arrested for allegedly communicating threats and simple assault against her neighbor in Leland.

Leggett, 49, a special education teacher at Ashley High School, was arrested and released on September 6 after her neighbor, Lana Allen, took out a warrant on the same day.

According to arrest warrants, Leggett is reported to have said to her neighbor that "she was going to beat her black ass."

The report also stated that there was probable cause the assault and threat to physically assault Leggett did happen and shows Leggett allegedly threatened Allen with a weed eater in her hand.

WECT has learned Allen and Leggett are related by marriage, and although Leggett referred to Allen as Black, Allen is Native American. 

According to New Hanover County officials, Leggett's employment status had been changed to "Suspended with Pay." The district decided to change her status pending the outcome of an investigation of the allegations. 

Leggett is now back teaching at Ashley High School following her suspension.

Prior to working in New Hanover County, Leggett also worked at the Brunswick County School system and the Pender County School System.

According to NHCS Deputy Superintendent Rick Holliday, Wanda Leggett was originally hired as an interim Special Education teacher at Sunset Park in February of 2014. She was then hired in a regular Special Education teaching position at Ashley on August 19 for the 2014-2015 school year. 

WECT tried contacting Leggett for comment, she hung up on us. According to her neighbors, she is a great neighbor not at fault. They told our reporter they saw the incident unfold.

"Don't get the wrong impression, come over and meet her. When my wife had her foot operated on, my knees were bad she was over here with food for us," Bob Wilson said.
