DALLAS CO., AL (WSFA) -

A Dallas County husband and wife are facing charges for allegedly sexually assaulting a family member in order to obtain a baby from her. Investigators say Jeremy Swan, 29, and Amanda Swan, 28, are both charged with rape.

Sgt. Mike Granthum says Amanda Swan apparently couldn't have a baby and wanted the victim, a 17-year-old family member, to have one for her. She is accused of watching the assaults while her husband repeatedly raped the teen.

A third person, Jeremy Swan's mother, was also charged with contributing to the delinquency of a minor because authorities say she knew what was happening but did not attempt to stop the crime.

A judge appointed taxpayer-funded legal council to the Swans at a court hearing Monday. No pleas after been entered at this point, but a preliminary hearing is set for September 9.

Detectives say the alleged abuse started in June. Granthum added there is no evidence the victim is pregnant. The victim is now with other family members and receiving counseling.
