LAKE WACCAMAW, NC (WECT) -

The Lake Waccamaw Fire Department is set to re-open Tuesday after being closed by the state fire marshal's office six months ago.

The department failed inspection in December due to problems with its roster and equipment.

The closing came during an intense controversy over the town's removal of longtime Fire and Rescue Chief Eddie Morgan.

The town and the Lake Waccamaw Fire and Rescue Auxiliary remain embroiled in legal proceedings over equipment.

The Auxiliary continues to provide EMS service through a contract with the county.

Surrounding fire departments have been responding to calls at Lake Waccamaw.

Mayor Daniel Hilburn reported the new fire department, part of town government, passed an inspection by the state fire marshal's office Monday morning. The department is expected to re-open Tuesday at 5 p.m., he said.

Hilburn said in April he wanted the department to provide EMS service as well – a move that would require Columbus County commissioners to rescind their contract with the Auxiliary and award it to the town.

The board instructed the county attorney to investigate the legal implications of the proposal.
