PENDER COUNTY, NC (WECT) - Residents of Pender County will vote Tuesday on a county referendum that could change the rules for businesses in regards to selling alcohol.

Right now, Pender County businesses that are not restaurants, hotels, or motels are not allowed to sell beer by the glass, but they are allowed to serve wine by the glass if they have an ABC permit. That's because of a law that passed in 1963.

Last summer, the owner of Quarter Moon, a bookstore and gift shop in Topsail Beach, was issued an ABC permit to sell beer by the glass. A couple of months later, the ABC board contacted the business saying they needed to revoke the permit because they discovered the older county law.

Last year, county commissioners adopted a resolution to hold the referendum at the request of the Town of Topsail Beach.
