Legal battle could be next for former DAK Americas employees
A group of 20 former employees of DAK Americas have hired an attorney to fight for every dollar of the pensions they have received.
BRUNSWICK COUNTY, NC (WECT) – A group of 20 former employees of DAK Americas have hired an attorney to fight for every dollar of the pensions they have received.
The employees accepted early retirement packages when the company announced it would be closing its facility in Brunswick County in 2013. One recent retiree showed us a letter that warned him his pension was miscalculated, so he owed nearly $30,000 back to the company.
Mitch Baker, of Baker & Slaughter PA, said many of these retirees can't return the money because it has already been spent or invested.
"Why in the world should they give it back," he said. "It's their pension funds."
Baker said he's investigating who is at fault for the mix-up, whether its DAK Americas or Transamerica Retirement Solutions, a the third-party company that handles benefits for DAK Americas.
If the former employees are not to blame for the mistake, Baker said they should not have to pay for it.
"They're the ones that worked for 40 years and they're entitled to this money," said Baker.
The plan is to file a petition with the company in the next 10 days, according to Baker. He said they will take any appeals to federal court if necessary.
