BRUNSWICK COUNTY, NC (WECT) – The second suspect shot during a checkpoint in Brunswick County earlier this month made his first appearance in court Tuesday.

Antoine Levar Graham, 34 of Leland, was released from the hospital and arrested Monday for his involvement in the incident.

Authorities say Graham and Jerry Onasis Melvin, 42 of Leland, drove through a checkpoint so deputies opened fire on the vehicle as it approached them.

Graham was charged with:

• 10 counts of assault with a deadly weapon with intent to kill

• 10 counts of assault with a deadly weapon on a government official

• one count of flee/elude arrest with a motor vehicle

• one count of felony conspiracy

• one count of possession of marijuana up to ½ ounce

• possession of drug paraphernalia

• assault on a female

• sell/deliver heroin

• possession with intent to manufacture, sell or deliver heroin

According to the sheriff's office, Graham is accused of assaulting a nurse June 16, while he was at the hospital.

The warrants say he "forcefully grabbed her by the arm while she was performing her duties as a nurse. After multiple request to release her, he continued to squeeze harder leaving large bruise on right arm."

Both the Brunswick and New Hanover County Sheriff's Offices are conducting internal investigations into the shooting. An independent investigation is also being conducted by the SBI. Sheriff Ingram reportedly requested that the SBI review the case.

District Attorney Jon David made a concurrent request for the SBI to get involved in the investigation.
