NEW HANOVER COUNTY, NC (WECT) - County Commissioner Jonathan Barfield is criticizing plans to oust Brian Berger.
Barfield said he supports censuring Berger but doesn't support plans to use a process called amotion to kick him out of his seat.
Barfield tells WECT.com that amotion is untested in the state. Amotion is most-often used by businesses to get rid of a board member.
He is concerned that it will cost the county a lot of money to get into a lengthy legal battle with Berger over the amotion process.
He believes going down this path is a waste of taxpayer money and the county would be better off waiting for Berger's term to expire in 2014.
Barfield is also concerned about the precedent the move will set in the state.
Still, when commissioners vote on the measure Monday, it is expected to pass by a vote of 3-2, if Berger shows up to the meeting.
The vote will clear the way for a date to be set up for a legal hearing on the amotion process.
