WILMINGTON, NC (WECT) - The driver who was suspected of hitting and killing a pedestrian on Market Street nearly two weeks ago will not be charged.

James Lawson, 53, was killed in the 2500 block of Market Street on Friday, April 5.

Wilmington Police Sgt. Mike Donaldson said the white jeep (seen in this video) that police towed from 5th Street a few hours after the accident did hit the man.

However, Donaldson said they believe the driver did not know he hit the man, which means he can't be charged with anything.

Police believe the victim either fell into the road or was lying with his head and shoulders in the road.

They are waiting for toxicology reports on the victim.

Donaldson said the driver was not impaired at the time of the crash.
