Officer won't see new trial for charge with split jury

TABOR CITY, NC (WECT) – Prosecutors have decided to not hold a new trial on an undecided charge for an officer with the Tabor City Police Department.

Officer Greg Sibbett went before a jury earlier this month for two counts of assault by pointing a gun and one count of unlawful restraint. He was found not guilty for those charges.

Jurors, however, were split nine to three for a second count of unlawful restraint. Prosecutors have decided not to hold a new trial for that charge.

Sibbett was accused of holding two teenagers, who were acting recklessly, at gunpoint outside the town's jurisdiction. He was indicted in 2009 for the charges.

Sibbett has remained with the Tabor City Police Department, doing administrative work, since the charges were filed in 2009.
