Police chief says facility never reported alleged sexual assault to investigators

Police are investigating allegations of a sexual assault that reportedly took place at an assisted living facility. Police are investigating allegations of a sexual assault that reportedly took place at an assisted living facility.

SHALLOTTE, NC (WECT) – Police are investigating allegations of a sexual assault that reportedly took place at an assisted living facility.

The victim's daughter, who we aren't naming to protect her mother's identity due to the nature of the alleged crime, told us that her 59-year-old mom is in the home due to mental illness.

The woman's mother said she woke up last Monday to another patient fondling her.

Her mother said she told workers at Shallotte Assisted Living about the incident.

According to Shallotte Police Chief Rodney Gause, Shallotte Assisted Living never reported the incident to police. Gause said the victim's mother filed the report with investigators.

WECT.com obtained a copy of the police report on Thursday. Gause said he could release very few details because this investigation deals with sexual assault.

It states that the victim's daughter reported the incident on Feb. 13.

In an exclusive interview with WECT, her daughter said it wasn't until Wednesday that she was informed by a medical technician about the allegations. She also claims the facility did not inform authorities about the complaint.

She said her mom is struggling with what happened.

"She's OK one minute," her daughter said. "She keeps saying that she's strong. Then, she doesn't want to speak about it."

Shallotte Chief Rodney Gause confirmed on Wednesday that they are investigating the case; however, he said the officer heading the investigation was in training courses on Wednesday, so we couldn't find out many details about what they've found so far.

We contacted the North Carolina Department of Social Services. At first, they told us they weren't aware of any complaints.

About an hour after first making contact with the agency, we were told that a team of surveyors were inside the facility on a complaint investigation. Jim Jones, from the N.C. DHHS Public Affairs Office, said he couldn't go into detail about the complaint.

He tells us complaint investigations typically require a couple of weeks at the minimum to complete before findings are presented in writing to the facility.

Gause told WECT.com that this case is now in the hands of the district attorney's office.

In an email sent to WECT.com, a police spokeswoman wrote, "At this time, if charges were brought forth it would be as a misdemeanor offense; as the information that we have been provided, thus far, does not meet the criteria for a felony sexual assault case."

David B. Goldston III, Executive Director of Shallotte Assisted Living Community says "we are cooperating with the police and DSS to aid in completing their investigation. Both agencies are doing a great job."
