UPSHUR COUNTY, TX (KLTV) -
Assault charges have been filed against the teen who was given 161 days in alternative school for hitting another student. The teen he hit had allegedly hit him the week before.
In November, the teen's mother petitioned the New Diana school board to reduce her son's punishment. They decided he would be allowed to go back to his high school when class resumes in January.
The Upshur County District Attorney says they were seeking felony assault charges against the boy, but because the injuries inflicted won't leave permanent damage, the charge is reduced to a misdemeanor.
