Carolina Beach approves smoking ban; pending approval from NC General Assembly

CAROLINA BEACH, NC (WECT) – Town leaders in Carolina Beach passed a smoking ban at the beach, making it the first seaside town in the state to support a ban of this kind. However, the ban is pending approval from the state legislature.

The town's attorney advised that Carolina Beach needs "enabling legislation" from the General Assembly, due to the fact that the town does not have jurisdiction over the beach. Some town leaders argued that since Carolina Beach is responsible for nourishment, the town should have the ability to make rules at the beach.

The Surfrider Foundation, a group that preserves and protects beaches, is calling the ban a win, even though it still needs state approval. Group members commend town leadership for moving forward with the ban. The vote was 4-1 with only Mayor Ray Rothrock voting against the ban.

Opponents of the measure feel their individual rights are being taken away by the government.

However, those in favor of the ban said it is a public health issue.
