TABOR CITY, NC (WECT) - While the SBI is investigating a shooting that took place at the home of State Senator R.C. Soles, the man Soles shot in the leg is recovering at his home in South Carolina.

Authorities said 22-year-old Thomas Kyle Blackburn and 23-year-old Billie J. Wright went to the senator's home and tried to kick down his door.  That's when they say Soles shot Blackburn in the leg.

It is unclear at this time if charges will be filed in Sunday's incident.

According to police reports, this is not the first time Blackburn has attempted to kick in the senator's front door. Blackburn was charged with attempted breaking and entering in September 2008.

Despite reports that a Tabor City police officer has seen a security tape showing Blackburn accompanied with B.J. Wright kicking in the senator's door, the Tabor City Police Chief said no one in his office as seen the tape.

WECT tried to speak with Blackburn, but were told to get off his property.

Senator Soles' attorney Joe Chesire would not return phone calls to confirm the type of gun that was used and whether surveillance video is, in fact, available.
