WILMINGTON, NC (WECT) - A young Wilmington man is expected go before a judge later this week after being charged with second degree murder.

According to state patrol, Jordan Whitley is accused of driving a car that struck and killed 45-year-old bicyclist Phil Tidmarsh on River Road September 9.

Toxicology reports show Whitley had morphine, THC and Xanex in his system at the time of the crash.

Whitley made his first appearance in October where his court date was continued.

"These cases, the investigation takes quite a bit of time with the accident reconstruction, testing, etc.," said Assistant District Attorney James Blanton in October.  "This is the normal course of events for this type of case."

Members of the Cape Fear Cyclists Club are planning to be present in the courtroom to stress the importance of making roads safer for bicyclists.
