AUGUST 1, 2005 -- An illegal immigrant accused in a drunk driving death is one step closer to trial.
A grand jury has indicted Ramiro Gallegos from Supply, on a charge of 2nd degree murder.
Gallegos is accused of causing a wreck that killed Scott Gardner, a teacher from Gaston County on vacation in the area.
His wife, Tina Gardner, is still in critical condition at the hospital. Their two young children were not seriously injured.
Gallegos has already been convicted twice of driving while impaired. He is in the Brunswick County jail.
