OCEAN ISLE BEACH, NC (WECT) - Family members of a woman who was killed in a parasailing accident are trying to file a lawsuit against the company involved.
Cynthia Woodcock and Lorrie Shoup died in a parasailing accident off Ocean Isle Beach, August 28.
In September, the owner of the parasailing operation involved testified the tow rope cut loose. Owner Barrett McMullan said the captain and first mate tried to chase down the parachute to rescue the women, but was too late.
Joel Rhine, who is the attorney for Woodcock's family, says family members are asking the US District Court in Wilmington for permission to file a state lawsuit against Ocean Isle Beach Watersports and North Carolina Watersports.
The family is asking the lawsuit be tried before the court considers the company's motion to limit or eliminate its liability in the deaths.
According to Rhine, the family just wants to prevent an accident like this from ever happening again.
